Terms of Service

1. Scope

These terms set the conditions for using monogo.jp (the "Service"), operated by Amelia Co., Ltd. ("we" or "us"). By using the Service you agree to these terms.

2. The Service

At your request we buy items for you from online shops, auctions, flea-market apps and other sellers in Japan ("Sellers"), receive and store them at our warehouse, and ship them to the address you choose.

We do not operate the Sellers' websites and are not the seller of any item. Responsibility under the sale contract lies with the Seller.

3. Account

If you are under 18, you must have a parent's or guardian's consent.

Each person may hold one account. Keep your details accurate and up to date.

You are responsible for your login details. We are not liable for losses caused by anyone else using them.

4. Orders, fees and payment

Fees are calculated in Japanese yen as shown on the Fees page (/fees) and at checkout. Amounts in other currencies are for reference; the exchange rate is fixed when you pay.

We buy the item after your payment is complete. If it cannot be bought because of a price change, sell-out or cancellation by the Seller, we refund the amount paid to your original payment method. We are not liable for differences caused by exchange-rate changes.

5. Cancellation and returns

Once we have bought the item from the Seller, you cannot cancel for your own reasons.

Returns and exchanges follow the Seller's rules. We do not guarantee that a return or exchange is possible.

6. Auctions

Bids cannot be withdrawn, and a won auction cannot be cancelled. Payment after winning follows our separate auction rules.

We are not liable if an auction is not won because of other bidders, cancellation by the Seller or similar reasons.

7. Prohibited items

Items we cannot buy or ship are listed on the Prohibited items page (/prohibited).

If a prohibited item is found at our warehouse, we may destroy it, and the item price and other fees are not refunded. You bear the cost of disposal.

8. Storage

Free storage days and storage fees are shown on the Fees page (/fees).

Items are stored free for 90 days from arrival at our warehouse; storage fees apply after that. Items not shipped within 120 days of arrival may be disposed of by us, and the item price and other fees are not refunded.

Until we dispose of them, storage fees keep accruing daily, including after 120 days.

Packed parcels follow the same rule, counted from the day packing is complete.

9. Inspection

Our inspection covers appearance and quantity only. We do not guarantee authenticity, working condition, quality or that an item matches the Seller's description.

10. International shipping

International shipping follows each carrier's rules. Delivery times are estimates, not guarantees.

Customs duties, import taxes and clearance fees charged in the destination country are paid by you.

If a parcel is returned because it was refused, the address was wrong or nobody received it, you pay the return and reshipping costs.

Loss, damage or delay in transit is handled within the carrier's compensation scheme. We accept no liability beyond it.

11. Disclaimer

We are not liable for losses caused by:

(1) the quality, authenticity or defects of an item, differences from the Seller's description, or other causes on the Seller's side;

(2) late shipping, non-shipping or bankruptcy of a Seller;

(3) delay, loss, seizure or destruction by a carrier or customs;

(4) import bans, seizure or destruction under the laws of the destination country;

(5) natural disasters, war, epidemics, network failures, outages of Sellers' websites or other causes beyond our control.

12. Limit of liability

Where we are liable to you, except in cases of our intent or gross negligence, our liability is limited to the amount you paid us for the item that caused the loss, and we are not liable for lost profits or other indirect losses.

13. Prohibited conduct

You must not register false information, use another person's payment method, use the Service for unlawful purposes, interfere with its operation, or do anything else we reasonably consider improper.

14. Suspension

If you breach these terms, we may suspend your use of the Service or delete your account without prior notice.

15. Changes

We may change these terms by posting them on the Service. Using the Service after a change means you accept the new terms.

16. Governing law and courts

These terms are governed by Japanese law. The Nagoya District Court has exclusive jurisdiction in the first instance over disputes about the Service.

This does not affect any mandatory rights consumers have under the laws of the country where you live.

17. Language

The Japanese text of these terms is the original. If a translation differs, the Japanese text governs.
